NCtech LLC Terms of Service

These NCtech LLC Terms of Service (“Terms”) govern your use of the Virtual Private Network (VPN) service (the “Service”), including our content (“Content”), applications (“Apps”), and software (“Software”), operated by NCtech LLC (“us,” “we,” or “our”).
1. Acceptance of Terms
By accessing, installing, or signing up, you agree to be legally bound by these Terms. The Service is strictly a privacy service and is not provided for the commission of criminal acts. You agree to comply with all applicable laws in all jurisdictions while using the Service. The Service is not available to those lacking legal capacity or previously terminated users.
2. Modification of Terms
We may modify these Terms at our sole discretion at any time. If a revision is material, we will provide at least thirty (30) days' notice. By continuing to use the Service after revisions take effect, you agree to the new Terms. It is your responsibility to review the Terms periodically.
3. User Accounts and Prohibited Use
You are responsible for maintaining the security of your account credentials and for all activity occurring under your account. You agree not to publish or share your account access with third parties.
Prohibited Activities: You agree not to use the Service for:
Sending unsolicited bulk email (spam).
Scanning for open ports, proxies, or relays.
Distributing viruses, malware, or other damaging software.
Hacking, cracking, network sabotage, phishing, or denial-of-service (DoS/DDoS) attacks.
Any conduct deemed illegal, harmful, or detrimental to the Service or other users.
Violation of this section may result in immediate suspension or termination. Users are liable for damages caused by the neglect or insecure configuration of their own systems.
4. Privacy Policy and Data Practices
We adhere to the principle of data minimization, collecting only necessary personal information during registration and for service operation. We are a no-logs VPN service. We do not monitor, record, log, or store information related to your VPN sessions, browsing behavior, websites visited, or any activity that matches your incoming and outgoing IP addresses or session duration. Refer to our separate Privacy Policy for full details.
5. Subscriptions and Billing
Subscriptions are automatically billed on a recurring basis (e.g., every 30, 180, 365 days, etc.) based on your selected plan. You must contact Support prior to the next scheduled billing date to cancel automatic renewal. Failure to cancel may result in a non-refundable charge for the next period. Our Free plan does not renew automatically.
6. Refund Policy
We offer a full refund if you notify us in writing within the first 30 days of your initial plan purchase, provided all three cumulative conditions are met:
You have not previously claimed a refund.
You have not violated these Terms.
The request is for your initial purchase (renewals do not qualify).
Refunds, if due, can take up to ten (10) days. For purchases via Google Play Store or Apple App Store, their respective refund policies apply instead of this general policy.
7. License and Intellectual Property
We grant you a non-exclusive, limited license to use the Software solely for accessing the Service. Modifying, reverse engineering, distributing, or decompiling the Software is strictly prohibited. Use of our intellectual property requires our explicit written consent. You may not assign or transfer your rights under these Terms without our prior written consent.
8. Third-Party Websites and Services
Our Service may contain links to third-party websites or services. We have no control over, and assume no responsibility for, the content, policies, or practices of any third parties. You acknowledge that we are not liable for any damage or loss connected with your use of or reliance on such third-party content or services.
9. Disclaimer of Warranties
The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind. Service coverage, speeds, and quality may vary and are subject to factors beyond our control (e.g., maintenance, third-party failures, signal strength). We are not responsible for lost, delayed, or misdirected data due to service interruptions. We may impose usage limits or suspend Service at our sole discretion. Network speed is an estimate, and the accuracy and timeliness of data are not guaranteed.
10. Limitation of Liability
In no event shall NCtech LLC, its directors, employees, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) resulting from: (i) your access to or inability to use the Service; (ii) any third-party conduct; (iii) any content obtained from the Service; or (iv) unauthorized access or alteration of your content. This limitation applies regardless of the legal theory (e.g., contract or negligence).
11. Governing Law
These Terms are governed and construed in accordance with the laws of Malaysia. Our failure to enforce any provision does not constitute a waiver of that right. These Terms constitute the entire agreement between us regarding the Service.
12. Severability
If any provision of these Terms is deemed invalid or unenforceable by a court, the remaining provisions will remain in full effect. The unenforceable provision shall be replaced by a valid, enforceable one that most closely reflects the original intent.
